Voters decide abortion issue in Nebraska

OMAHA, Neb. (WOWT) – Voters in Nebraska have decided firmly in favor of one of the state's two conflicting abortion measures.

AP announced the results of Initiative 439 just before 2:30 a.m. Wednesday, showing voters rejected the abortion rights ballot initiative. Initiative 434 had been called more than two hours earlier, with Nebraska voting to maintain existing abortion restrictions.

The issue remains controversial in the state, with both sides arguing before the Nebraska Supreme Court in September to allow both measures to come to a vote at all.

State officials argued that the matter violated Nebraska's “single subject rule.” The rule itself was controversial and was argued multiple times before the state Supreme Court. She kept medical marijuana off the Nebraska ballot in 2020 and upheld a new state law that classified gender-affirming care and abortion laws as a single issue.

Reactions:

Nebraska Right to Life joins other members of the Protect Women and Children coalition in celebrating the passage of Ballot Measure No. 434, which amends the Nebraska Constitution to protect babies in the womb after the first trimester, except in cases of rape, Incest or medical emergency.

“We are so grateful to all the people who worked tirelessly at the grassroots level to educate the public on this issue so they could make an informed decision at the polls,” said Sandy Danek, executive director of Nebraska Right to Life. “Nebraskans have spoken; They voted for the dignity of both mothers and the children in their wombs.”

Measure No. 434 was introduced in response to competing Ballot Measure No. 439, which was promoted by the abortion industry. “The language of 439 was so deceptively vague that it would have allowed abortions up to birth,” Danek explained. “It would also have gutted many of the laws that Nebraskans have enacted over the past decades that provide protections and standards of care for women and children,” she added.

“With their vote, Nebraskans showed that they reject the extremism represented in Measure 439,” Danek said. “As we move forward, Nebraska Right to Life will continue to provide education and resources to transform hearts and minds toward a culture of life.”
