Voters decide abortion issue in Nebraska

OMAHA, Neb. (WOWT) – Voters in Nebraska have decided firmly in favor of one of the state's two conflicting abortion measures.

AP announced the results of Initiative 439 just before 2:30 a.m. Wednesday, showing voters rejected the abortion rights ballot initiative. Initiative 434 had been called more than two hours earlier, with Nebraska voting to maintain existing abortion restrictions.

The issue remains controversial in the state, with both sides arguing before the Nebraska Supreme Court in September to allow both measures to come to a vote at all.

State officials argued that the matter violated Nebraska's “single subject rule.” The rule itself was controversial and was argued multiple times before the state Supreme Court. She kept medical marijuana off the Nebraska ballot in 2020 and upheld a new state law that classified gender-affirming care and abortion laws as a single issue.
