Iowa Supreme Court Justice David May and other justices face a retention vote

Iowans will vote Tuesday on whether to retain dozens of state judges, including four judges on the Iowa Court of Appeals and one justice on the Iowa Supreme Court.

Under Iowa law, judges are appointed by the governor and then subject to regular elections. All Iowans can vote on appellate judges, while district judges appear on the ballot in their respective counties.

At the top of this year's list is Justice David May, appointed to the Supreme Court in 2022 and facing his first retention vote. In his first two years as a judge, May was involved in several high-profile cases, most notably the ruling in favor of Iowa's six-week abortion ban.

Also on retainer are Judges Tyler Buller, Mary Elizabeth Chicchelly, Samuel Langholz and Chief Justice Mary Ellen Tabor of the Iowa Court of Appeals, the state's intermediate appeals court. Tabor has been on the pitch since 2010, Chicchelly since 2021, Buller since 2022 and Langholz since 2023.

Most voters will also have one or more local district judges and associate judges on their ballots, with 64 statewide up for retention. That includes eight judges in District 5C, which covers Polk County.

Iowans have traditionally voted to grant new terms to almost all justices, with the notable exception of three Iowa Supreme Court justices who lost their seats following a landmark 2009 ruling that upheld a constitutional right to gay rights. Marriage established.
