OMAHA, Neb. (AP) — Nebraska voters chose to support the state's 12-week abortion ban over a competing proposal to allow abortion until fetal viability, according to an Associated Press call.

The ballot measure, which bans second- and third-trimester abortions with some exceptions, is tied to the state constitution. It also allows lawmakers to further restrict access to abortions.

Nebraska was one of 10 states that had abortion on the ballot this election. But it was the only state where voters faced two competing proposals. While voters passed the 12-week ban amendment, they rejected the one allowing abortion until the fetus is viable, according to the Associated Press.

As in other states, abortion rights advocates had mobilized to place the feasibility question on the ballot in response to the U.S. Supreme Court striking down federal abortion rights in 2022. They argued that abortion is a private decision for pregnant people and their families – not one for the government.

The conflicting efforts to maintain Nebraska's 12-week ban — while allowing further restrictions in the future — arose in response to the fetal viability initiative.

Its supporters argued it would give voters a choice on the ballot and provide a “common sense approach.” Republican U.S. Sen. Pete Ricketts of Nebraska and his mother Marlene Ricketts donated more than $5 million to the campaign.
